SMS/MMS Mobile Message Marketing Program Terms and Conditions

Camoli Distribution Inc. (hereinafter "We", "Our") offers a mobile messaging program (the "Program") in which you agree to participate and use, subject to these Mobile Messaging Terms and Conditions (the "Agreement"). We may modify or cancel the Program or any of its features without notice. This Agreement is limited to the Program and is not intended to modify other terms and conditions or the privacy policy that may govern the relationship between you and us in other contexts. We may also modify this Agreement at any time and your continued use of the Program after the effective date of such modifications constitutes your acceptance of such changes.

The Program allows users to receive SMS/MMS mobile messages by registering for the Program, such as through online or app-based subscription forms. Your consent to receive automated marketing text messages is not required for the purchase of goods or services. Regardless of the method of registration you choose to join the Program, you agree that this Agreement applies to your participation in the Program. If you have registered, the Program sends you updates, alerts, information, promotions, special offers and other marketing offers (e.g., product discounts) from Camoli Distribution Inc. via text messages to your mobile phone, from the number you provide. SMS/MMS mobile messages may be sent using an automated telephone dialing system or other technology. Message frequency may vary. You are responsible for all charges associated with text messages imposed by your wireless service provider. Message and data rates may apply.

If you do not wish to continue participating in the Program or no longer agree to this Agreement, you agree to respond STOP to any mobile message from us to unsubscribe from the Program. You may receive an additional mobile message confirming your decision to unsubscribe. You understand and agree that the foregoing options are the only reasonable methods of unsubscribing. You also understand and agree that any other method of unsubscribing, including, but not limited to, texting words other than those set forth above or verbally requesting one of our employees to remove you from our list, is not a reasonable method of unsubscribing.

For any questions, text the word "HELP" to the number from which you received the messages. You can also contact us for more information. If you wish to unsubscribe, please follow the procedures above.

We may change the telephone number we use for the operation of the Program at any time and will notify you of such changes. You acknowledge that any message, including any STOP or HELP request, that you send to a telephone number that we have changed may not be received and we will not be responsible for honoring it.

The mobile carriers supported by the Program are not responsible for delayed or undelivered messages. You agree to provide us with a valid mobile phone number. You agree to provide us with accurate, complete and current information regarding your receipt of messages, including, without limitation, immediately notifying us of any change in your mobile phone number.

You agree to indemnify, defend and hold us harmless from any third party claims, liabilities, damages or costs arising from your use of the Program or your provision of a telephone number that is not yours. If at any time you intend to discontinue use of the mobile telephone number used to enroll in the Program, including by canceling your service plan or selling or transferring the telephone number to another party, you agree to follow the opt-out process described above before terminating use of the mobile telephone number. You understand and agree that your agreement to do so is a part of these Terms and Conditions. You further agree that if you change your telephone number without notifying us, you will be responsible for all costs (including attorneys' fees) and liabilities incurred by us or any party involved in the delivery of SMS/MMS mobile messages, due to claims brought by persons to whom that mobile telephone number is subsequently assigned. This obligation and agreement will survive any cancellation or termination of your agreement to participate in any of our Programs.

You agree that we will not be liable for any non-delivery, delay or misdelivery of any information sent through the Program, for any errors in such information and/or for any actions you may or may not take in reliance on the information or service.

You may not use or access the Platform if you are under the age of thirteen (13). If you are using or accessing the Platform and are between the ages of thirteen (13) and eighteen (18), you must obtain permission from your parent or legal guardian to do so. By using or accessing the Platform, you acknowledge and agree that you are not under the age of thirteen (13), are between the ages of thirteen (13) and eighteen (18) and have permission from your parent or legal guardian to use or access the Platform, or are of legal age in your jurisdiction. By using or accessing the Platform, you also acknowledge and agree that you are permitted by applicable law in your jurisdiction to use and/or access the Platform.
